Terms of Service
Last updated — July 23, 2026These terms govern your use of this website and any engagement with ScalesDraft ("we," "us," "our") for custom software development services. By using this site or engaging us for a project, you agree to these terms.
Who we are
ScalesDraft is a custom B2B software studio. We design and build bespoke software platforms for individual clients — we do not sell off-the-shelf products or templates through this site.
This website
Everything on this site — the demos, mockups, and screenshots shown in the "Our work" section — represents real software we've built for real clients, shown to illustrate our range and capability. It does not constitute an offer to license or resell that specific software; each engagement is a new, custom build.
How an engagement works
Submitting a form on this site is an inquiry, not a contract. A working engagement only begins once we've had a consult call, agreed on scope, and both signed a separate written agreement covering the specific project, timeline, and pricing for your build.
Ownership of your software
This is core to how we work: once a project is delivered and paid for in full, the client owns the software, the codebase, and the data it generates. We do not retain licensing rights over delivered work, and we do not lock clients into our infrastructure. The specific terms of ownership, source code handover, and any post-launch support are defined in your individual project agreement.
Payment
Pricing, deposits, and payment schedules are set out per project in your individual agreement, not on this website. We reserve the right to pause or stop work on overdue accounts as specified in that agreement.
What we're not liable for
We build software carefully, but like any engineering work, we can't guarantee it will be error-free or uninterrupted forever. To the extent permitted by law, ScalesDraft is not liable for indirect, incidental, or consequential damages arising from use of delivered software or this website, beyond what's explicitly agreed in your project contract.
Third-party services
This website uses third-party infrastructure (including Google Fonts, a Supabase-hosted database, and CDN-hosted scripts) to operate. We aren't responsible for outages or issues originating from those providers.
Governing law
These terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these terms or a project agreement will be handled under the jurisdiction specified in that individual agreement.
Changes to these terms
We may update these terms as the business evolves. The date at the top of this page reflects the latest revision. Continued use of the site after a change means you accept the updated terms.
